My guess is that since it's stalling so much more than a stock verter would it's producing more heat so and the stock pressure vs heat settings cause it to apply/release when you're out of range.
Adjusting the pressure to make up for the added slip/heat allows it to stay locked when it needs to be?

Is that kind of right?

any other suggestions? any kind of throttle movement and it unlocks.

last night with the temps in the 60s we got the converter to lock with around a 60rpm slip(normal i suppose) today with temps in the mid 90s slip is bad again, not unlocking but slipping up to 700rpm.

stock trans with shift kit and 40k gvw cooler...any ideas? seems to be temp related

Since it seems to be Temp related you could try lowering your Force Motor Current table a very very little bit in the low TQ ranges for the tranny temps your seeing... Remember this table controls the pressure for the entire tranny. So increasing/decresing will affect everything... Also this table works backwards, a lower number increases the pressure, a higher decreases the pressure...

its also started to shutter at higher rpm..whats the possibility that the tcc is bad?

A friend of mine had a similar problem his TCC would unlock really really easiely and eventually it stopped locking up. It ended up being a cracked TCC soleniod...
