I read this on msn earlier, I dont consider myself a sue happy person but if this was my house that they watched burn to the ground with my family pets inside, while standing gaurd to make sure the fire didnt run over to the neighbors house I would be out for blood right now with my attorney's.....

It's a tough situation....on one hand, EMT's and firefighter's have some degree of a "Duty to Act"....on the other, it's advertised and known as a paid service. Sucks for the home-owner, but I'd bet no amount of fancy lawyers would get a dime out of that deal!

It's like flood insurance in Louisiana...or car insurance everywhere else, IMO! You don't tell the insurance company, after you had a wreck, that you'll pay whatever it takes to get them to pay for it!
What happens when they sue the department, and somehow win and get it shut down? It closes, the city or community gets it voted on to start a real department that is funded by taxes....how much do taxes increase? I bet it's alot more than $75 a year!! Will they pay the taxes, or forget??
Like I said...it's a tough one because they knew the way the system works, and has even has runnings in with fire and that department before. They knew it had to be paid to get help....yet they "forgot" anyway. But you never want someone's family or even pets to die in a fire, that just sucks no matter how you look at it. I'm torn but am enjoying seeing forum members get all up in arms about it for one side or the other of the argument. That's a good sign that people still care about something except themselves!

I'm gonna have to agree that they should have paid up. They knew how the system worked in their area and failed to pay. Great example on the Car/Home insurance. If you don't pay your fee then you don't get any help if something happens.
The home owner knew the rules and tried his luck. Unfortunately for him his luck wasn't that good.
Edit: I do believe they should only be required to intervene when a life is in danger. Whether it be a person or animal. They should show up and rescue said life but not be required to put out the fire once achieved.

What would everyone say in this case:
A sweet little old 90 year old lady has a really bad cancer. There is a local doctor who can treat it with a very high success rate, but the procedure is CRAZY expensive. Insurance would cover it, if she had it, but she doesn't have it....and the doctor won't operate without cash payment. She'll die without the procedure.

There are already plenty of said examples that happen daily tho. Also plenty where they have insurance but insurance won't cover it to save the persons life.
