The owner and the driver are one in the same. I have pictures of my injuries from the night it happened. Im calling my lawyer in the morning and seeing what can be done. You can bet if this goes to court I will be taking them for everything I can

So you were supposed to hit the car that pulled out in front of YOU risking your life or much more serious injuries instead of laying it down like you should do? That doesn't make much sense...

Damn man. I laid my 74 CJ5 over on it's side avoiding an accident where an old lady ran a redlight to prevent from putting my c-channel bumper through the passenger window at an angle (they were turning left in front of me) and killing the other blue hair with her in her Honda. They stoped because they saw the wreck and were oblivious to their fault. I had several whitnesses and the cop said since you didn't hit them there was no point in filing a report. They said it would go nowhere or you'd spend a fortune on legal fees and just hope whitnesses would cooperate, which would interfere with life schedules, jobs etc. So, I just cut my losses and paid the wrecker driver to turn me over and put some more oil in it that ran out and cut my losses. Used a tree and a comalong to pull the windshield frame back straight and everything else is still scratched up to this day.

You have 1 thing going for you, a nice person at fault. One thing I would have done though is not have left a message and just tried till I got them on the phone or just left a nice message saying you needed more info and not gave out that there was controversy....cause now she has the choice to get involved or not. Damn Cody....your a dumbass for that.
Maybe things will work out for the best.

Lol! I guess i'm showing my age. Saw it for years on tv commercials for car/work accidents advertizements. The horindous singing of the number has stuck in my head like they wanted.

I had the EXACT SAME EXCUSE handed to me by an insurance company when a dude pulled out in front of me a few years ago. He pulled out in front of me, I swerved left because he stopped in front of me - instinct - then he took off and got back in front of me. Bam, it was done. **** the fact that he pulled out in front of me, they said that I "took the improper evasive action to avoid hitting their client" and therefore were not going to pay on the claim

you could always make a craigslist ad and say everything in her address is free as long as someone picks it up.



JK...hope everything works out man, Insurance companies are the worst.

Insurance companies will get away with whatever they can get away with. I would go to their office and say that their decision is unacceptable, and see what happens.

I have a little experience with this. You need to take your info to your insurance carrier and get your adjuster to fight for you. I promise that he dosent want to pay out of your policy. If you let him contact the other adjuster and let them hash it out they will probly get things ironed out. If they dont then it is attorney time. If you go attorney to soon it is going to take FOREVER to get your claim paid and you will have to gibe 40% of your award to the attorney Just let your insurance company work for you. If they dont pay your company will pay and subrogate with the other company for the damages.

I agree - I forgot to mention to submit a claim to your insurance(if you have more than liability only) and they will take care of you.

But...on the second part of Dock's post, I don't think you'll find an attorney to take the case on contingency. In other words, they will want money from you up front whether you win or not. I considered this when I was in your position and it was going to cost more to fight it than it would to just fix my truck out-of-pocket.
