Default So pissed right now

Well as alot of you probably know I laid my bike down a couple weeks ago and I just got a letter in the mail saying that the bitches ins company isnt going to cover the damages because I took "faulty evasive action". WTF, jsut that description there seems to show liability on their part. I was EVADING HER because she failed to yield the right of way. I didnt get the police to come out cause I just got scratched up a bit and the vehicles didnt collide and she seemed like a nice lady. Lesson learned and I will be talking to the lawyer tomorrow. This is what I get for being a nice guy and not wanting to make a big deal out of it. You can bet I wont be just asking for just damages when it goes to court.

That sucks man, that is bullshit.. By what they are saying it is clear that they are considering it her fault, how can you take faulty evasive actions?? WTF?? You try to advoid the wreck, if you do great if not then well you wreck.. Where is the fault in this? I know you dont know either, it just pisses me off the way insurance companies are.

I called her and left a message in a very nice tone no cussing etc asking how they came to that conclusion, we will see if she calls back.

Dude, go see the doctor if you haven't already. Start getting witnesses. Insurance companies are the biggest pieces of **** around. Go see a doctor and get him to note injuries, then have your lawyer ask for maximum damages. Have your attorney sue the driver and the owner of the vehicle independently. You need to ask for maximum now since legal bills are going to eat up a lot of your settlement. The insurance company may back down and give you something now versus fighting a legal battle.

Don't worry about her being a nice lady. You were a nice guy, and looked what happened.
