Default Big problem with transmission shop and I need help

I have a 2002 Tahoe 4x4 and the transmission went out 3 to 4 months ago. I took it to a shop and paid $3500 for them to rebuild it with 100,000 mile waranty. In the first month the 5 pinion planetary gear busted completely with just city and highway driving so I took it back and they replaced it for free.
Well 3 more months go by which is now and the has planetary busted again. The Tahoe is stock and I dont pull anything and I dont go offroad other than grass. They told me they wont fix it under waranty because they said I must have been to rough on it and it was going to be $1400 to replace the planetary gears.
I am looking for everyones opinion on what I should do on the situation. Any help would be appritiated because I am going to school currently and I had to get a small loan just to pay for the $3500.

Did you get a written warranty? That just sucks and it sounds like they gouged you too.

Yea I got a written waranty. Im not exactly sure where it is at the moment I think it is in my glove box in my car at their shop. When they told me the news I told them not to touch it until I called back and let them know something.

WOW, there's no easy way to say this but they raped you on the $3500

IMO, find another shop or order a FLT(sponsor to the right) level 3 60e trans, about 1500 i think and it has a gurantee and they WILL back it up. if you want proof they will just go to the sponsor feedback section and look at all the flt reviews that are good/great, i dont know of a single bad report on the FLT trans

plus if later on you decide to add more power and need a bult trans, you can send it in and they will upgrade it for parts cost only

btw, where in TN are you

I was wondering if I should sue the transmission shop for breaking their waranty and not giving me what I paid for.

You don't have to say who the shop is, but is it a big name place or a local mechanic? If you have a written warranty then you should have no worries. They have to prove you abused it to void your warranty!!! It does suck though for that money you could have bought a really really stout tranny from a great tranny builder!

It is a local mechanic but well know. If I had thought about the money I should of put a 4l80 in it. I am going tomorow to get quotes tomorow on the repair or just to put a new trans in. I am going to go talk to my attorney and see what he thinks and maybe have him make a call to the shop.

I had something similar happen to me once, I sued, won but never saw a dime. Here it is 10 years later and I have a collector trying to get my $$ but I don't have high hopes.
You can always make a sign and a big stink in front of his shop until he gives in? I've actually seen that work.

With you on this one don't just give in, were talking about $3500. Have him give the shop a call for sure!
