I hear ya Bill. I certainly understand the need of such laws and restrictions. But I certainly also disagree with carpet bombing. Just litter the area with overwhelming rules to cover all instances, really bordering the grey(gray) area of protection/prevention to harassment.
To me a law, should individually serve a specific purpose. Arresting you becuase you have a 3 month old budweiser can in your truck is ridiculous and excessive force IMO. Everyone bitches the cops are dicks and blah blah blah (insert john babble pic here) but it isn't their fault. It's the soft belly of society THINKING it is taking care of problems by just creating more laws and heavier fines for pretty much innocent things.
Basically, the law is there because lawmakers don't trust the public. Not because the law keeps drunks off the road. I am sure the law wasn't created with the intention of no trust, but that's the result. Poor decision making skills almost always derive from emotional reasoning and not logical reasoning. (it's fun to beat this topic up, cuz who would dare argue that drinking and driving is safe. kinda like "it's for the children")

In Oklahoma if you can get in trouble for an opencontainer in the drivers compartment. It's cool if it's in the trunk or the bed. But you still have to be under .08. .08 or over is DUI and below .08 is DWI. Either way you are screwed. Best bet is to just get a ride and keep all open containers in the bed, If you have been drinking that nigh just don't drive at all.

In PA you cannot have ANY open alcohol containers in the vehicle while driving. Instant DUI or jail. I probably should of told you this before i gave you a cooler full of beer before you left my house lol

Yup
doesn't matter if it was emptied 3 months ago. You get in big trouble, arrested and car impounded.
I'm not much of a pro-law guy but in this case the laws need to be heavy (sorry doooey) Like you started the thread by saying we have all seen the destruction driving impaired can cause to property and lives.

I travel every where with a drink. LMAO, I almost feel bad, but I baby drinks so bad I know my BAC is waaaaay below .08. No where near it. My brother in law has breatherlizer, I tried it one time. I had a drink on the way to his house. (about same distance as a trip home from work) It barely registered. Had to do it like three times.

Do they consider an opened case to be an open container? or an open can/bottle? or both?
If its an open box that's just BS.
The laws aren't like that because law makers don't trust the public, the laws are like that because it brings in money.
If cops really want to they can come into your local bar and start arresting anyone who doesn't have a DD for public intoxication. It happened in Texas.
