Think of it like this.....you have a tractor-trailer in your lane headed for you.....do you want to stand your ground or make way for it? The larger vessel does not have right of way unless it can prove RAM like a tanker or freghter. A larger pleasure boat is not a RAM vessel

Not only can the larger boat Ram you, but it's easier for a smaller boat to maneuver than a larger boat. Which is why that unwritten rule exists. The larger the boat is heavier it takes to turn or stop. So the smaller should do so.

In this case, both captains are morons. Luckily they have it all on film. If someone starts suing its an easy decision for the courts to say "fix your own damn boat"/.

 

The license I was referring to would be for operating a Commercial boat. Which it looked like the smaller one may have been. No license requirement for a recreational boat.
