Oil levels and 1-2nd gear shutter

Oil levels and 1-2nd gear shutter
I have two questions I am hoping you guys can help me out with.
1.) I recently changed my oil and according to the haynes manual (yea I know) I am supposed to run the engine for a minute then shut it off and check the oil. If I do this the oil level is perfect, just below the hash marks. If I check the oil without doing this and when the oil is cold the oil level is maybe 1/2 an inch or more above the hash marks. The dealership said the Haynes manual way is cool and that my oil level is cool.
SO what is cool? Am I checking the oil properly for this truck? Its a 03 Sierra with the 5.3L.
2.) I have noticed that when starting from a dead stop and accelerating more agressively that I feel a shake or shutter through the lower gears. At first I thought maybe it was something with tire traction but I remember reading something about a 1-2nd gear shudder in our trannys. So whats up with this? Is it something I should tell the dealer about?
Its a new truck and I paid a good amount of cash for it so obviously I want to be sure its running perfect. Is this shutter going to eventually become worse or a reliability/performance problem? Anything I can have them do to fix it? Anyway if anyone has info on this issue please let me know.

My trans. does the same thing on the 1-2 shift under hard acceleration. I bought mine used and the warranty is out so I'm just gonna wait till it breaks and put something stronger in. Maybe someone else knows a little more about the problem.
The way you do the oil is fine. The oil is gonna be higher on the stick after it has sat because most of it has drained back down into the pan. I usually fill mine up to the top of the hash marks(since I know it will burn off/blow out) but, anywhere in that area on the stick should be fine.
