WTH is wrong with Nissan??

No, the newest version is compliant with all crash saftey reg's, so it's legal for sale in the states. The motor never had anything to do with it's legallity over here, it was all in the crash worthiness. You can import the older one's into Canada now for around 15-20k USD, but to upgrade it to be US legal is another 10k or so, lol.
Personally I'm not surprised. The Titan's were the front runners for this. Ask any Nissan guy about the ECU's on those bad boys, lol. I'm sure that with this article they're talking about Drivetrain problems. All manufacturers do it. Nissan is just taking the next step and rather than rely on your story and their technicians to figure it out, they're using onboard monitoring to double check. Can't say I blame them really. Those motors aren't cheap.....

In Car and Driver, the GT-R review had Nissan engineers were touting the PCM and being "unhackable".

They (Nissan) also claimed 0-60 in 3.5 seconds, and the quarter in 11.7 (no speed given). Strikes me as difficult for a 3800lb car with 480hp and 430lb-ft of torque. The 911 Turbo has the same peak hp, more torque (460) and is 300lb lighter. Both are AWD. The 911 is only good for 3.7 and 12.0 in the quarter. Is someone using a downhill test track?
